Privacy policy
Yadda yadda. A privacy policy, which we’re legally bound to create. How fun!… but on a serious note, we do care about making sure your personal information is kept safe, and that you know what information we may collect about you.
Your data will be treated in accordance with the Personal Information Protection and Electronic Documents Act (SC 2000, c 5; only when it applies to us), the Act respecting the protection of personal information in the private sector (CQLR c P-39.1) and any other Canadian federal or provincial privacy legislation applicable to you.
Applicability of the policy
This policy applies with regard to Juritrans / the Trans Legal Collective. It also applies with regard to Celeste Trianon (as an individual), if the page content is copyrighted under her name.
Website logging
Juritrans / the Trans Legal Collective follows a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this and a part of hosting services’ analytics. The information collected by log files include internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable. The purpose of the information is for analyzing trends, administering the site, tracking users’ movement on the website, and gathering demographic information.
Your information in general
We may collect several forms of personally identifiable information, depending on the services you wish to obtain from us. These will only be collected if you submit said information explicitly to us, except, in the case of emails, your first and last name, which we may automatically collect.
Your personal information may be used for several purposes internally within our organization, including providing services to you. Said information will be managed according to the “Client information confidentiality” part of this policy, except if mentioned otherwise.
Your personal information may be shared by anyone within Juritrans, notably our board of directors, employees, volunteers and partners.
We will not disclose your personal information to law enforcement unless a subpoena is issued against us. However, in that case, we will be obligated to comply with the law. In these cases, we will disclose the subpoena as soon as legally possible to you.
Client information confidentiality
Juritrans / the Trans Legal Collective makes sure all client information is kept confidential, and on this end, within the organization.
Paper files shall remain within the organization, except if handed back to the client, if permission has been given by the client, or submitted to its intended recipient (for example: we may submit a completed passport application to Passports Canada if asked to).
Emails may contain inherent vulnerabilities. As a mitigating measure, we strive to delete client-associated emails — for example, inquiries regarding how the name change process works — no later than one (1) year after the file becomes inactive. For confidential files, such as ones containing complete name change files, a person’s address of domicile (in a form other than an email signature), or a person’s social insurance number, these ones will be deleted no more than sixty (60) days after the file becomes inactive.
Persons may request the deletion of any client-associated email regarding them, on demand, to any concerned person at Juritrans / the Trans Legal Collective, in particular the person who may have worked on your file.
Electronic communications are inherently subject to vulnerabilities, such as phishing, spear phishing, and other cybersecurity risks. In the event that any communication interception or unauthorized breach occurs, we shall strive to notify any concerned persons as soon as possible. To avoid such risks, mitigating measures, such as solely exchanging personally identifiable information via electronic meetings (such as Microsoft Teams) or in person, may be taken.
In the event that legal advice is given by a lawyer associated with us or a lawyer we have referred you to, their firm’s privacy policy, as well as, in Québec, the Act respecting the Barreau du Québec (CQLR c B-1) and its regulations, applies.
Young persons
As part of our work, we may collect information on young persons. Said information shall be collected the same way as for adult persons, and shall be treated equally, except in the event a parent or legal guardian with parental authority is involved. In that case, we will listen to said parent or legal guardian’s request to delete information about the young person in question (unless the young person explicitly objects). However, we shall not disclose information about the young person to said parent or legal guardian without the former’s consent.
Data sharing and third parties
Juritrans / the Trans Legal Collective may share your information with third parties, by virtue of the services we use that enable us to run our programs and our website.
Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. We try to minimize the amount of embedded content stored with third parties, but do note that a good part of it is stored via Wordpress.com, a service we use in order to notably improve website performance.
Notably, we use embedded content for:
- newsletter management (Mailchimp, a product of Intuit LLC);
- donation management (9355-0861 Québec Inc., d.b.a. Zeffy; Stripe Inc.);
- legislative campaigning (New Mode Consulting Inc.).
Additionally, do note that our emails, internal cloud storage, and other such things are operated with Microsoft 365, and as such, will be subject to their privacy policy for their respective products.
These websites and services may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website. We recommend using website plugins, such as Mozilla’s “Facebook Container”, or other web solutions such as cookie blocking, to avoid tracking in those cases. Do note though that such use may lead to reduced functionality on this website.
Finally, we also provide links to third party websites for your convenience. It is your responsibility to make sure to read their respective privacy policies as well.
Request the deletion of your personal information
If you are a service user or client of Juritrans, you, or if applicable, your attorney, may request the deletion of any client-associated email regarding yourself, on demand, to any concerned person at Juritrans / the Trans Legal Collective, in particular the person who may have worked on your file. Parents and legal guardians may also do so on behalf of their children, unless the latter objects. We will comply to the best of our capabilities.
